Guarantee, Warranty and Guarantee – excerpt from the GTC

Definition
- Warranty of goods : In the event of defective performance by the seller, the consumer/buyer may assert rights under the Civil Code (Ptk.) and, in the case of a consumer contract, under Government Decree 373/2021. (VI. 30.).
- Product warranty : In the event of a defect in a movable item (goods), the manufacturer or distributor can be requested to repair or replace the product.
- Warranty : A statutory mandatory warranty for durable consumer goods; a guarantee voluntarily undertaken by the business; with a more favorable burden of proof for the consumer.
Warranty – for consumers
- The defect must be reported immediately after discovery; the defect is considered to have been reported within two months of discovery. After two years from performance, the rights can no longer be enforced.
- The consumer may, at his/her choice, request repair or replacement; if this is impossible or would entail disproportionate additional costs, he/she may request a price reduction or withdraw from the contract.
- The limitation period for warranty claims begins anew for the part affected by the repair or replacement.
- Within one year, the seller can only request notification of the defect; after one year, the consumer has the burden of proving that the defect existed at the time of performance.
- In the case of digital content, the repair or replacement must be carried out within a reasonable time after notification of the defect, without significant inconvenience.
- Warranty claims against the company can be asserted in parallel with product warranty claims against the manufacturer.
Customers not considered consumers, SMEs
- In the case of non-consumers, the deadline for warranty claims is 1 year from the date of performance (transfer).
- The defect must be reported immediately after discovery; rights cannot be asserted after the statute of limitations.
- Other rules are the same as for consumer product warranties.
Product warranty
- In the event of a defect in a movable item, the consumer may request that the manufacturer or distributor repair or replace the product.
- A product warranty claim can be asserted within two years from the date the product was placed on the market by the manufacturer; after this deadline, the right expires.
- The manufacturer is exempted if he proves that the defect in the product did not exist at the time of placing it on the market or that the cause of the defect is due to a violation of the applicable standard.
- A warranty claim and a product warranty claim can be asserted simultaneously due to the same defect, but after a successful product warranty claim, the warranty right can only be exercised against the manufacturer.
Mandatory warranty (warranty period, repair, replacement)
- The mandatory warranty applies to durable consumer goods with a selling price of HUF 10,000 or more.
- The warranty period according to Government Decree 151/2003. (IX. 22.):
- Warranty is not mandatory for consumer goods below the selling price of HUF 10,000.
- 2 years for sales prices of HUF 10,000 but not exceeding HUF 250,000.
- 3 years for sales prices above HUF 250,000.
- The warranty period begins upon delivery of the goods or on the date of installation by the Seller.
- The lack of a warranty card does not affect the validity of the warranty; for prices below HUF 50,000, the receipt is sufficient to prove the warranty.
- Rights under the warranty : the buyer may request repair or replacement; if the obligor fails to comply with these within a reasonable time, he may request a price reduction or withdraw from the contract.
- The Seller shall endeavour to complete the repair or replacement within 15 days ; if the repair takes longer than 15 days, the Buyer shall be informed of the expected duration.
- If the consumer product is determined to be non-repairable upon initial repair, it must be replaced or the purchase price refunded within 8 days .
- If the Seller is unable to correct the defect within 30 days , then (i) with the consent of the Buyer, it may also correct it at a later date, (ii) failing this, it must be replaced within 8 days after the unsuccessful expiration of 30 days, or (iii) if replacement is not possible, the purchase price must be refunded within 8 days.
- If the product fails for the fourth time during the warranty period, the product must be replaced within 8 days or the purchase price must be refunded, unless otherwise specified by the buyer.
- Products heavier than 10 kg or with fixed connections - with the exception of vehicles - must be repaired at the place of operation; if this is not possible, the company will arrange for the removal and return.
- The Seller is obliged to record the notification of the warranty claim and provide a copy thereof to the consumer; if the Seller is unable to immediately state whether the claim can be fulfilled, the consumer must be informed in writing within 5 working days at the latest.

Warranty, component warranty and product warranty claims can be asserted primarily at the Seller's headquarters or at the designated repair service. Complaints can be made via the customer service contact details provided on the website, by post or by e-mail.
